Temporary Homes

Council’s Subordinate Local Law No. 1.3 (Establishment or Occupation of a Temporary Home) 2012 provides the opportunity for a person to occupy or establish a temporary home for up to 18 months.

Building and plumbing approvals will be required if a permanent structure is being built. You are required to make separate enquiries in relation to these areas. The information on this page is only in relation to the activities delegated to the Environment and Health section.

Making an application

An Approval to Establish or Occupy a Temporary Home is to be completed and submitted to Council with the required fee. The application may require the following information:

  • A drawing showing the design and dimensions of the proposed temporary home.
  • Details of the materials out of which the temporary home is constructed and other structural details of the temporary home.
  • A sie plan of the location of the temporary home within the property.
  • Written consent of the owner of the land on which the temporary home is proposed if the applicant is not the owner of the land.
  • Details of the name of each person who is to occupy the temporary home.
  • Details of the proposed temporary home including toilet, bathing, laundry, water storage and refuse facilities.
  • If a permanent residence or permanent structure is proposed to be constructed on the land the subject of the application—a copy of the development approval for the permanent residence or permanent structure.
  • Details on the cost of both erecting the temporary structure and construction of permanent residence or structure and the permanent residence/structure.
  • Proof that the financial resources of the applicant are such that the applicant is capable of funding the construction of the temporary home and the permanent residence, including an itemised list of costs.
  • If the applicant is an owner/builder—evidence that the applicant is registered as an owner/builder with the Queensland Building Services Authority.

Council’s Environmental Health Officers will review the application and conduct an inspection of the temporary home. If approval is granted, conditions will be imposed as a part of the approval.

Approval Renewal

An approval cannot be renewed, however the approval may be extended to coincide with the expected completion date of the permanent residence if it is likely to be completed within a reasonable timeframe.
