Footpath Usage
A number of business activities operate on Council road and park areas. To ensure public access and amenity is maintained requirements have been established for approving these activities.
All activities on Council land or the road are required to have and maintain public liability insurance. A copy of the current insurance policy schedule is to be provided with the application.
Permits on state-controlled roads are also required to be approved by Department of Transport and Main Roads. No separate application to the department is required. Council will provide the required form and condition your approval.
The main state-controlled roads are sections of Queen Street and Edwards Street in Ayr and Eighth Ave in Home Hill and the Bruce Highway.
Transfer of Approval
A transfer is not applicable for the approvals issued under Subordinate Local Law No. 1.2 (Commercial Use of Local Government Controlled Areas and Roads) 2012, nor for A or T frame mobile signs.
Advertising Signs
There are a number of different signs that require approval under Subordinate Local Law No. 1.4 (Installation of Advertising Devices) 2012, including:
- A or T frame/mobile signs
- Roof/sky sign
- Under awning sign
- Billboard/Hoarding sign
- Inflatable sign
The most popular sign is the A or T frame signs/mobile signs and these require annual renewal.
The A or T frame sign may have a maximum of 2 faces – each face is not to exceed 2m2. Only one sign will be approved for each business facing a road. Further requirements are listed in the Attachment to the Application form.
Making an Application
An Approval to Install an Advertising Device Application is to be completed and submitted to Council with the required fee and documentation.
Other Council Approvals
An approval for a permanent sign such as billboard/hoarding, under awning and roof/sky signs may require separate approval from Council’s Town Planning and/or Building sections. You are required to make separate enquiries in relation to these areas. The Approvals listed on this page are only in relation to those delegated to the Environment and Health section.
Goods on Footpath
Approval is required under Subordinate Local Law No. 1.2 (Commercial Use of Local Government Controlled Areas and Roads) 2012 when businesses intend to display goods for sale on the footpath. Goods are to be displayed against the outer wall of the business this is to maintain safe pedestrian access to businesses.
Make an Application
An Approval for Commercial Use of Local Government Controlled Areas and Roads Application is to be completed and submitted to Council with the required fee. The application must include a site plan with the layout of the footpath and proof of public liability insurance.
As part of the Application you will be required to determine the area of the footpath to be used, this will determine your application fee.
A plan of where the goods will be placed is to be provided with your application. Other items such as planters, seats, lights etc. are to be indicated on the plan. The area of display is not to exceed the boundaries of your business.
The goods are only to be on display during the business’ opening hours. Further information on conditions are available in the Subordinate Local Law.
Footpath Dining
Food businesses may apply for approval under Subordinate Local Law No. 1.2 (Commercial Use of Local Government Controlled Areas and Roads) 2012 to place tables and chairs on the footpath adjacent to their business. The area is to be located adjacent to the outer wall of their premise.
The area, including tables, chairs and the like are to be maintained in a clean condition and bins are to be provided for the use of diners.
The footpath dining area is to be set up only during the business’ opening hours. Further information on conditions are available in the Subordinate Local Law.
Make an Application
An Approval for Commercial Use of Local Government Controlled Areas and Roads Application is to be completed and submitted to Council with the required fee. The application must include a site plan with the layout of the footpath and your proof of public liability insurance.

Roadside Vending/Food Vending
Prior to making formal application it is recommended that you make a written request to Council for in-principal approval.
The written request is to include hours and days of operation, proposed location/s, information on what is to be sold as well as a pictures of the vehicle or stall.
If approved in principal an application will be required.
